Two federal laws direct the education of children with disabilities in our country:

  • the Every Student Success Act (ESSA) and
  • the Individuals with Disabilities Education Improvement Act (IDEIA).

The Every Student Success Act (ESSA) was signed into law in 2015, reauthorizing the Elementary and Secondary Education Act. 

The Individuals with Disabilities Education Improvement Act (IDEIA) of 2004 defines the requirements that states must follow to identify and serve students with disabilities. The final Part B Regulations (addressing children 3-21 years of age) were published in the Federal Register on August 14, 2006. The Part B regulations at 34 CFR Parts 300 and 301 took effect on October 13, 2006.
